Malaysia: Single mum escapes gallows

ALOR SETAR: A single mother escaped the gallows after the High Court here ordered her drug trafficking charge to be reduced to drug possession.

Che Yam Saad, 54, from Kampung Padang Lalang in Langkawi, was initially charged with trafficking in 598.55gm of cannabis under Section 39B of the Dangerous Drugs Act.

The cannabis was found in her house on Feb 25, 2003.

Judicial Commissioner Zamani A. Rahim ordered the charge to be amended to possession under Section 6 of the same Act and sentenced her under Section 39A (2) of the same Act at the end of the prosecution’s case yesterday.

Che Yam pleaded guilty to the amended charged and was sentenced to 16 years’ jail from the date of her arrest.

Zamani said the prosecution had told the court that the accused was carrying a paper bag when police raided the house.

Counsel Mohd Nizan Azdahari in his mitigation said Che Yam was a single mother and had three school-going children at the time of arrest.

DPP Ridha Abdah Subri asked the court to give a deterrent sentence.
