UK: Carer could face jail for growing cannabis
Harborough Today Monday 07 Nov 2005 Carer could face jail for growing cannabis A MAN who said he grew cannabis to help him cope with life caring for his epileptic partner and three-year-old child could be facing a prison sentence. Paul George Smith, of The Headlands, in Harborough, pleaded guilty to cultivating 12 cannabis plants and having eight methylenedioxymethamphetamine (MDMA) tablets and 0.77grammes of amphetamine on him when police raided his home in June this year. On Tuesday, Harborough magistrates heard how officers found cannabis plants under the stairs of Smith's home. They were being grown hydroponically (using water and lights) and other plants were found in his back garden. Cannabis resin and drug paraphernalia were also found at the address. Smith's defence solicitor Kay Christison told the court Smith, who stays at home to care for his partner and their child, had asked for help from the authorities back in May but has heard nothing. She added: "He has a three-year-old child and his partner is epileptic and says he has not been able to cope." "The reason he has used drugs is as an antidepressant and to keep him going." The court clerk, who advises magistrates on the law, said that despite the recent downgrading of cannabis, cultivating plants could be viewed as a deliberate defiance of the law and magistrates should be looking at a six month custodial sentence as their starting point. The case was adjourned until November 24 for pre-sentence reports and Smith was released on unconditional bail.
