US: Med Pot Fugitive Captured

Saturday 28 Jan 2006 SAN FRANCISCO — Medical marijuana crusader Steve Kubby is back in California to serve jail time after spending several years as a fugitive in Canada. Police say Kubby was arrested yesterday after arriving at San Francisco International Airport from Vancouver. Kubby will face a 120-day jail sentence he received in 2001 in Placer County for possession of the hallucinogen mescaline and psychedelic mushroom. Kubby repeatedly sought refugee status in Canada, claiming he was persecuted for his advocacy of medical marijuana use. But a Canadian court rejected Kubby’s appeals earlier this week and he was ordered to return to the U.S. Kubby says he needs marijuana to curb symptoms of a rare type of cancer and says he will suffer and die without it in jail. A hearing is set for Tuesday in Placer County. His lawyer plans to file a motion to allow Kubby to use medical marijuana in jail. Kubby ran for governor of California in 1998 under the Libertarian party banner.
