UK: No jail for growing cannabis

Monday 06 Feb 2006 A man has narrowly avoided prison after police found a mini cannabis farm in his flat. John Conway was handed a two-month suspended sentence by Wigan Magistrates Court and told he will be ordered to serve the time in jail if he doesn't do 200 hours community service. The 39-year-old contacted police on January 25 to complain that youths had been kicking the door of his Eckersley Precinct flat in Atherton. Conway invited officers up to his flat. They could smell cannabis and asked if they could have a look around. He said he hadn't got anything to hide and allowed them to search the property. In the dark spare bedroom they found five cannabis plants and two cannabis seedlings as well as a variety of equipment. Alan Bakker, prosecuting, said: "He told officers that he only grew it so he didn't have to see dealers. He said that it was his second batch of plants and had learned how to grow them from books and the Internet." The court heard that Conway – who pleaded guilty – had previous drug related offences but had successfully beaten a heroin addiction. As part of his drug rehabilitation treatment he was on medication which included diamorphine. When he was taken off that he struggled with pain and used cannabis to alleviate it. Tony Weims, defending, said: "His last offence was eight years ago and in that time he has pulled himself together. The last person he wanted contact with was drug dealers. "Here is a man who has struggled beyond belief to rid himself of an addiction and not re-offended." Conway was handed a two-month custodial sentence suspended for 12 months, given 200 hours community service and ordered to pay £70 in costs. His cannabis equipment was also confiscated.
