Malaysia: Man gets 11 years, 10 strokes for drugs

Friday 24 Feb 2006 PENANG: A 33-year-old businessman was jailed for 11 years and three months and ordered to be given 10 strokes of the rotan by a High Court here yesterday after admitting to possession of 34.5kg of cannabis. Rosman Mohd Ismail, of Air Itam, pleaded guilty to an alternative charge of drug possession under Section 6 of the 1952 Dangerous Drug Act, which carries a maximum 20 years' imprisonment and 25 strokes of the rotan. He had earlier claimed trial to a charge of drug trafficking on July 21, 2003, under Section 39(B) of the Dangerous Drugs Act, which carries a mandatory death sentence. Justice Datuk Su Geok Yiam, in passing the sentence, said her decision was made based on the consideration of the facts that it was a serious offence. "It involves drugs, which are the country's No. 1 enemy, and the sentence will act as a deterrent for others and the accused himself not to repeat the offence in future. "I am giving a one-fourth discount of the sentence because the accused is a first offender and saved the court's time by pleading guilty." In mitigation, Rosman's counsel, P. Latsmanan, asked for a light sentence because his client had given full cooperation to the police since his arrest on March 23, 2003. "Rosman was also the breadwinner of a family of five as he had to start working after completing primary school because his security guard father could not earn enough to feed his family. "The accused lived in a squatter area in Air Itam and this led him to mixing with bad company." DPP Azman Abu Hassan said drug abuse cases had become quite rampant and a hefty sentence would act as a deterrent to others. "The huge amount of drugs found in the accused's possession could have been used to destroy many other souls if he was not arrested then," said Azman. Rosman was arrested in a friend's house in Bagan Lalang, Butterworth on March 23, 2003.
