Italy: Drugs - More than 20 Spliffs is Trafficking

Tuesday 04 Apr 2006 (AGI) - Rome, 4 April - More than 5g of cannabis (marijuana and hashish) and 1.6g of cocaine in your pocket is seen as trafficking drugs. The parameters were set out by the Ministerial Commission and presented at the prime minister's office by Minister Giovanardi. For the experts the "limits" are equal to around 20 spliffs of cannabis and 5 lines of cocaine. The Commission clarified the single average quantity, being the quantity for every 'dose' suitable for producing in a person a drugged effect. This parameter was then multiplied on the basis of the characteristics of each class of substance and with particular attention to the possibility of inducing behavioural changes and psychological changes. From this, limits resulted. For the Minster for Parliamentary Relations Carlo Giovanardi "Up until today there's been total arbitrariness and it can happen that a drug addict can be convicted or not only on the basis of the judge's discretion, setting aside the type of quantity of the drug. This way, however, there are valid scientific parameters and under the threshold is personal use for which the drug user will not be penalised, a victim who wants to reform". The Minster emphasised however that over this threshold comprises "drug trafficking and with drug traffickers - he says - we want the law to step in because the traffickers of death must be beaten". In short, with the limits fixed by the Ministerial commission, in practice, whoever ahs 250mg of heroine (equal to 10 doses), 750 mg of cocaine (equal to 5 doses), 500 mg of hashish (around 20 spliffs), 750 mg of ecstasy (equal to five doses), 500 mg of amphetamines (equal to 5 doses) and 0.150 mg of Lsd (equal to 3 stamps - 3 doses), does not risk being considered a trafficker. If, however, one of these parameters is exceeded, it goes from use to trafficking. But even here - the commission experts explained - if the threshold is exceeded by a little, the small time traffickers would be sent to a community for recovery rather than to prison. - The "traffickers" - that is, those who exceed the ceilings set down by the experts commission. Risk from 6 to 20 tears, while the small time traffickers the sentence is to be reduced in the recovery centre. For those simply using drugs, however, the penalties are administrative such as driving licence or passport suspension etc.(AGI) -
