US: Court declines to rehear pot king case

Wednesday 19 Jul 2006 SAN FRANCISCO - A federal appeals court declined Wednesday to review its decision overturning pot guru Ed Rosenthal's conviction for growing marijuana. Rosenthal, who has written books on how to grow marijuana and how to avoid getting caught, was convicted three years ago for cultivating hundreds of marijuana plants for a city of Oakland medical marijuana program. He was sentenced to one day in prison after U.S. District Judge Charles Breyer said it was reasonable the Oakland man thought he was immune from prosecution because a 1996 state law allowed medical marijuana use. Both sides had appealed, with prosecutors seeking a stiffer sentence and the defendant seeking to clear his record. The 9th U.S. Circuit Court of Appeals reversed the jury verdict in April because of misconduct by a juror who consulted an attorney on how to decide the case. It affirmed that decision Wednesday. Prosecutors declined to say whether they'll take the case to U.S. Supreme Court or seek a new trial. The case is United States v.
