Monday 04 Dec 2006 Do our judges always tell the whole truth? The Legalise Cannabis Alliance (LCA) is concerned that judges do not seem to tell the juries of their full rights. Alun Buffry, a spokesman for the LCA, said: "We always hear judges telling the Jury that they must reach their verdict based on the evidence they hear during the trial. They never mention that a juror is in the position to consider whether or not the law has been applied correctly and justly. "Of course, every trial has been considered by the police and legal profession, the CPS, and they have decided that the prosecution is in public interest and success is feasible. "But those people are not the ones who decide will guilt or innocence. "A good example would be if a person was prosecuted for possession of a drug after confiscating it from a child and about to hand it in. Technically, the evidence would be irrefutable. But would the defendant deserve prosecution and punishment. They may be asked to show their intent to hand it in was genuine - but it would fall on the prosecution to prove otherwise. "Another example, one that concerns me greatly, is the prosecution of people for possession, cultivation and even supply of cannabis when it is for the purposes of fighting pain, muscle spasms and other terrible symptoms. "Most of those people admit the facts, but where is the harm? Where are their victims? Do they deserve punishment by law. "The judges may not tell the jury that they can say not guilty if they consider the law has been mis-applied - but they can! I urge everyone to stop these terribly unjust prosecutions by voting not guilty whatever the judge says, if they sit on such a trial."
