US: Council votes to prohibit marijuana dispensaries

Thursday 05 Apr 2007 The new ordinance bans all land uses that violate state or federal law. The City Council on Monday voted 5-0 to approve two ordinances that will prohibit the establishment of medical marijuana dispensaries in Mission Viejo. An urgency ordinance, which is effective immediately, prohibits all land uses that violate state or federal law. The ordinance also prohibits uses that are permitted under state law, but are prohibited under federal law, such as medical marijuana dispensaries. Also approved was a similar ordinance, adding a section to the municipal code prohibiting all land uses that violate state or federal law. It will be effective 30 days after its second reading. These ordinances were introduced in light of the upcoming May 16 expiration of an existing ordinance which enacted a moratorium on the establishment of medical marijuana dispensaries in the city. Originally introduced May 15, 2005, the council adopted the ordinance amid controversy over the regulation of medical marijuana. California voters decided to let doctors prescribe medical marijuana by passing Prop. 215 in 1996. However, the U.S. Supreme Court ruled on June 6, 2005 that federal authorities could prosecute people who cultivated or possessed the substance, regardless of doctor's approval.
