An application made against the UK Government by myself and others is due to be considered by the European Court of Human Rights in Strasbourg, France. (Application number 51056/99 Alun BUFFRY et al v United Kingdom)

This application was made in 1999 and is supported by some 350 personal statements along with some several thousand signatures. These signatures include doctors, lawyers and people from many walks of life and many different ages and backgrounds, including some from other countries.
They represent a much larger group.

The application concerns the infringement of Article 9 of the European Convention of Human Rights and Fundamental Freedoms through the implementation of the Misuse of Drugs Act on those people who use cannabis under the belief that it is of benefit to them in one or more ways.

The said convention makes quite clear the criteria under which a Government may take away a persons Rights as recognised under this and other Articles: in the interests of law AND in order to protect the Rights of others or to protect public health, public order or morale.

Clearly the personal use of cannabis poses no threat to the Rights of others, public order or health, and we have provided the court with scientific evidence from expert studies to confirm this without doubt.

There is no justification for the interference of the law in the practice of the belief that cannabis use if of benefit, and therefore the application of the Misuse of Drugs Act and other prohibition legislation is a contravention of Human rights. The enforcement of that
law, the arrest of people, searching of houses and other property, incarceration etc, are all therefore illegal acts under the Convention.
