Gordon Brown is to introduce tougher penalties for cannabis use despite a report out today saying it should remain a Class C drug.

The Prime Minister's plans to upgrade it to Class B could mean offenders getting up to five years' jail and an unlimited fine instead of a warning.

It is a clear snub to the Advisory Council on the Misuse of Drugs review which says there is no case for change.

A No10 source said: "We've a wider remit than simply the scientific evidence."

Experts claim in today's ACMD report says that there is no evidence a rise in cannabis use had led to an increase in schizophrenia.

Its guidance follows recommendations in 2002 and 2006 which also said cannabis should stay Class C.
