UK: Epileptic man is spared jail

AN EPILEPTIC Burton man who grew cannabis at his home to help him cope with his illness has been spared an immediate jail term.

Police discovered a hydroponic cultivation system at Gary Webster's house after arresting him at a pub in Tamworth.

Plain clothes officers in the Anchor public house in the town saw Webster acting suspiciously with another man and, when he was arrested, he was found to have two bags of cannabis - one with a street value of £150, the other £120.

Police then searched his home and found the hydroponic system, which was being used to grow four plants. Also found were scales and paraphernalia of drug use and drug dealing.

Webster, 41, of Hazlewood Road, Burton, admitted possessing cannabis and cannabis vegetation with intent to supply and producing cannabis.

He was given an eight-month prison sentence, but Recorder Mr David Jones suspended it for two years.

He told Webster: "You suffer seriously from epilepsy. I suspect you have been possessing (cannabis) and dealing in it to help you with your epilepsy. That may be an excuse. If you do persist, even with just possessing cannabis, you are likely to go to prison next time."

Michelle Heeley, defending, told Stafford Crown Court: "He found cannabis had fewer side effects than the medication he was taking for epilepsy. Because of his epilepsy he is unable to work."
