UK: Suspended sentence for selling drugs

Rutland and Stamford Mercury

Friday 28 Nov 2008

A WOMAN who admitted dealing in cannabis to fund her own habit has been given a suspended jail sentence.
Nicola Daly, 20, was caught with 11 bags of cannabis valued at £190 and £305 in cash when police stopped her car in Stamford.

The 20-year-old admitted she had been dealing "on and off" for a year and had sold 12 bags of £20 cannabis that day, Simon Rowe, prosecuting, said.

Lincoln Crown Court heard Daly was bailed by police but began dealing again after threats were made to her family.

Police executed a search warrant at Daly's home in Essex Road, Stamford, and found a further 60 grams of cannabis valued at £360 and £80 in cash, Mr Rowe told the court.

During her second interview Daly admitted paying £450 for the cannabis and said she intended to sell two-thirds of the cannabis for about £500 to fund her own habit, the court heard.

Emily Coates, mitigating, said Daly had a "difficult background" and had been smoking cannabis since the age of 14.

"She was only supplying cannabis to friends and people she knew who smoked it. It was at the very lowest level and it was not for profit," Miss Coates added.

Miss Coates told the court Daly only returned to dealing cannabis the second time she was caught after threats were made to her.

"Somebody higher up the chain said her fingers would be cut off and posted back to her mother," Miss Coates said.

Daly, of Essex Road, Stamford, admitted possessing cannabis with intent, supplying cannabis and possessing criminal property between December 23 and May 13.

Judge John Machin deferred sentence on Daly to assess her suitablity for a drugs rehabilitation order and told her she would recieve a suspended jail term.

He told her: "You are very lucky. Next time it will be prison."
