Canada: One year for drug trafficking

A 45-year-old Sudbury man with no criminal record received a one-year jail term in Sudbury court after pleading guilty to possession of cannabis resin for the purpose of trafficking.

He is also out almost $3,500 that police seized during a search of his home.

Acting on a tip, police searched Brian Specht's home on May 15 and found 232 grams of the drug, along with $3,4754 in cash.

The drug is worth about $4,680, said federal prosecutor Serge Treherne.

This was not a case where it was a highly successful commercial operation, Specht's lawyer told the judge. The substance itself is a derivative and not of the same quality as some drugs, he said.

Ontario Court Justice Gerald Michel went along with a joint submission from the Crown and defence lawyers that Specht be allowed to serve the jail term in the community as a conditional sentence.

Under the terms of the sentence, Specht will not be allowed out of his house except to go to work, medical emergencies and for four hours on Saturdays for personal shopping.

During the second half of the sentence, he will be under a 11 p. m. to 6 a. m. curfew. Michel ordered the cash confiscated.

Specht was prohibited from owning or possessing weapons for the next decade.

"You now have a record," Michel said. "If you should attempt to do it again, you probably will spend considerable time in jail."

He was told if he did not follow the conditions of the conditional sentence order, he could be charged with that offence and may end up spending the remainder of the sentence behind bars.
