UK: Church man avoids jail after growing cannabis Wendy Barlow Lancashire Telegraph Saturday 22 Aug 2009 Burnley Crown Court heard how Jan Ashworth-Howarth, 22, was producing the drugs for his own use because of weight worries and because a conflict in medication he was taking meant he couldn't sleep. The defendant had earlier been given a 34 week jail term, suspended for two years, after admitting assault causing actual bodily harm and was in breach of it. Ashworth-Howarth, of Warwick Close, Church, admitted producing cannabis . He was given an eight week jail term , suspended for 18 months, with 100 hours unpaid work. Judge Norman Wright told him the suspended term had been given for a completely different sort of offence and it would not be appropriate to activate it. Sarah Statham, prosecuting, said on June 8, police went to the defendant's home and found a makeshift wooden shelter with six mature cannabis plants in a bedroom A fan and halogen lamp were being used . The defendant was arrested and interviewed and admitted full responsibility. He had three previous convictions. Amy Nicholson, defending, said Ashworth-Howarth was keen to go back to work and was doing everything he could to make himself employable. The cannabis growing was wholly unsophisticated and he was not using a hydroponic system. Miss Nicholson went on :"Custody would have a devastating effect on his life at this stage.
