Malaysia: Veggie, fish sellers to hang for drugs

A vegetable seller and a fishmonger are to hang for trafficking more than 300 grammes dangerous drugs used in 3,000 ecstasy pills.

High Court judge Datuk Syed Ahmad Helmy Syed Ahmad this morning sentenced vegetable seller Tong Chong Men, 48, and fish seller Cheah Choon Heng, 39, to death by hanging after finding them guilty of two charges of trafficking dangerous drugs under Section 39B(1)(a) of the Dangerous Drugs Act 1952 for trafficking 248.4 grammes 'Methylenedioxymethamphetamine' (MDMA) on Sept 24, 2007, about 9.30pm in front of a furniture store in Jalan SJ17/A, Taman Selayang Jaya, Batu Caves, Gombak.

They were also charged with trafficking 88.6grammes Ketamine at the same place, date and time. The drugs were detected after chemical tests were conducted on 3,000 ecstasy pills taken from them.

Syed Ahmad, in his judgement, stated he found prosecution had proven its case beyond reasonable doubt. Deputy Public Prosecutor Yong Leou Shin said eight prosecution witnesses were called up while the defence called three witnesses, including the two accused.

Tong was represented by counsel Zaki Ezhar Bahar while counsel Afifuddin Hafifi represented Cheah.

At another High Court here, two other accused avoided the hangman after pleading guilty to an alternate charge of drug possession.

Plumber Jasmani Othman, 40, and technician Abdul Hamid Ali Sadari, 29, were initially charged under Section 39B(1)(a) of the Dangerous Drugs Act which carries the death sentence.

The court heard they had rejected the prosecution's offer of an alternate charge early in the trial, but changed their mind during the defence stage and requested for the alternate charge.

This morning, Jasmani and Abdul Hamid pleaded guilty under Section 6 of Dangerous Drugs Act to possessing 930g of cannabis on Dec 18, 2007, about 10.15pm at a vacant lot in Batu 1, Jalan Paip, Meru, Klang.

Judge Datuk Wira Mohtarudin Baki sentenced them to 12 years imprisonment from their date of arrest and 10 strokes of the rotan each.

Jasmani was represented by counsel Mohamad Rafique Rashid Ali and Rosal Azimin Ahmad represented Abdul Hamid. DPP Rosidah Abu Bakar prosecuted.
