Malaysia: Lorry Driver Gets Nine Years' Jail, Whipping For Possession Of 755gm Cannabis

lorry driver was sentenced to nine years' jail and 10 strokes of the rotan by the High Court here today after he changed his plea to guilty of possessing 755gm of cannabis two years ago.

Judicial Commissioner Siti Khadijah Sheikh Hassan Badjenid ordered C.S.Gunalan, 28, to serve the jail sentence from the date of his arrest on Dec 22, 2008.

He committed the offence at about 8pm in Jalan 2, Desa Jaya, Kepong, Gombak.

Prior to this, Gunalan pleaded not guilty to a drug trafficking charge under Section 39 B (1)(a) of the Dangerous Drugs Act 1952, which carries the mandatory death penalty upon conviction.

However, he changed his plea after the prosecution offered an alternative charge under Section 6 of the same Act, which carries life imprisonment and a minimum of 10 strokes of the rotan if convicted.

Deputy public prosecutor Zainal Azwar Kamaruddin prosecuted while Gunalan was represented by lawyer Naran Singh.
