UK: Man caught with dying cannabis plants was storing them for a friend
thisislincolnshire Tuesday 15 Feb 2011 Police officers found David James Cawdron in charge of the plants at his home in Holly Street, off Brant Road, Lincoln, on January 19. They were set up with sodium lights and the room had been altered to allow the plants to grow unhindered, Lincoln Magistrates' Court heard yesterday. When police asked him if he had the plants on his premises, he said yes and told them where to look. Marie Stace, prosecuting, said the plants were in bad condition. "They were pretty dried up and not in a healthy state," she said. Cawdron pleaded guilty to permitting the production of a controlled drug of Class B on his premises. Leo Pyle, mitigating, said: "Mr Cawdron is not in the best of health, he has chronic emphysema and has had to bring oxygen today. "He is not a smoker or a user of cannabis. "About seven weeks before this, he was asked to keep the plants because the person who owned them was moving. "He had a spare bedroom and allowed the man to store them. The plants were all male so no crop could be taken from them." The court heard that Cawdron gave the man a key to the property. "Mr Cawdron spends two or three nights a week with his partner in Grimsby," said Mr Pyle. "He came back to find the man had installed a propagation unit. That was not what Mr Cawdron thought would happen. "In those seven weeks he had been constantly calling this individual to get him to come and remove everything." The court heard that Cawdron turned off all the apparatus and when the police officers arrived, the plants were dying. And it was the day the officers attended that the owner of the plants had told Cawdron he would return to take the plants and all the equipment away. Mr Pyle said: "There is no money involved and no evidence of usage of a lot of electricity. "He effectively killed the plants off by turning the electricity off. "He receives disability living allowance for his health. "His family have taken a strong interest in this and are trying to move him closer to his sister's house so they can keep an eye on him so that others are not going to prey on him." Magistrates fined Cawdron £50 plus a £15 victim surcharge.
