Australia: Judge rejects cannabis 'surprise'

Northern Star

Thursday 14 Apr 2011

A STONY Chute man was "quite surprised" when he threw a few cannabis seeds in his vege patch and 17 cannabis plants up to one metre high grew in their place, a court has heard.

But an unconvinced Magistrate R Denes did not buy the story, recited by Ashley Martin's defence lawyer Tracey Randall.

"I accept the submission there was no hydroponic system or lighting but ...I don't accept that people throw seeds and don’t expect them to grow," Ms Denes said.

The North Coast had been well-known for the cultivation of cannabis since the 1960's, Ms Denes said.

Mr Martin, 38, appeared in Lismore Local Court on Monday charged with cultivation of cannabis and possession of 2.4 kg of cannabis following a drug raid by police at a Stony Chute property on November 18.

The accused pleaded guilty to both charges.
