UK: Darlington man faces prison after growing marijuana to numb spinal pain

A MAN with a spinal condition says he will continue to use marijuana to numb his pain despite facing prison.

Stephen Tull used his walking stick to make his way into the dock at Darlington Magistrates' Court to answer the charge of growing 27 cannabis plants earlier this month.

Blair Martin said the Crown Prosecution Service accepted that, despite the number of plants, there was no intention to supply and the marijuana was medicinal.

After Tull pleaded guilty, the court decided its sentencing powers, of up to six months in prison, were not sufficient and passed the case up to Teesside Crown Court.

Speaking from his Darlington home, the 59-year-old, who suffers from a condition effecting the cartilage in his spine, said: "I have good and bad days. The pain is always there, but sometimes it can really be unbearable.

"I am prescribed morphine-based medication, which can leave me light-headed and fuzzy. Sometimes I get to places and don’t really remember how I got there, the medication can leave you confused and dazed.

"Marijuana offers me more effective pain relief. I’ve never taken anything that has dulled my pain as effectively and it doesn’t give me any kind of fuzzy head like the morphine does."

Mr Martin told the court that police arrived in Tull's street on the evening of May 12 to execute a search warrant at another address.

"When Mr Tull noticed the police, he said ‘' know why you are here’ before leading them up to his attic where the cannabis was growing, despite the police having a warrant for a different address."

said Mr Martin.

After his court appearance, Tull said: "It's madness really. The police were great, the CPS were great and the magistrates didn’t look like they wanted me to be there.

"I'd like to know how it's in the public interest to make me into a criminal. I don’t think the justice system is there to serve this purpose.

"There were no guidelines available to the magistrates, but similar cases have seen jail terms of nine and 12 months handed down."

Tull will be sentenced at Teesside court, on August 8.
