US: No prison for man caught with 100 pounds of pot

A squeaky-clean record helped a California man dodge prison Friday even though state police caught him with nearly 100 pounds of marijuana.
Jason D. Burns-Doak, 34, of 12682 Quail Run Road, Chico, Calif., pleaded guilty Friday to a reduced cannabis possession charge and was sentenced to 4 years of non-reporting probation and was ordered to pay fines and costs of 40,000 USD.
Burns-Doak declined an opportunity to address Judge Cynthia M. Raccuglia before sentencing.

He was charged Feb. 7 on Interstate 80 near Utica, where he cut off a tractor-trailer and caught the eye of a state trooper.

Burns-Doak, who said he was en route from Nevada to Connecticut, refused to let the troopers search his vehicle, so a drug-sniffing dog was brought to the scene and alerted to nine bags of cannabis weighing 98.6 pounds.
Burns-Doak was facing 6-30 years in prison with no possibility of probation. However, he and Ottawa defense attorney Ed Kuleck negotiated a plea that leaves him with a criminal conviction and forfeits both the drugs and the $40,000 he posted to be released from jail.

Assistant La Salle County state’s attorney Jeremiah Adams said prosecutors agreed to the plea in consideration of Burns-Doak’s lack of criminal history and some evidentiary concerns about the search and seizure.
