UK: No trial for man in 2.80 UK Pounds cannabis case

Plymouth Herald

Friday 23 Sep 2011

A MAN accused of possessing cannabis worth £2.80 will not face trial.

James Molloy had elected to be tried at Plymouth Crown Court after pleading not guilty before city magistrates to possessing half a gramme of the drug.

At a previous hearing, Judge Paul Darlow commented: "I would have thought we had bigger fish to fry."

The court heard that Molloy, aged 32 and of Exeter Street, was one of several men in a car stopped by police, but denied the cannabis was his or that he had dropped it on the floor.

Judge Darlow suggested the officers could have taken a pragmatic approach, asking Molloy if the cannabis they found was his and telling him when he said no: "Then you won't mind if we flush it down the nearest drain?"

Yesterday, the Crown Prosecution Service announced that it was offering no evidence against Molloy, who is currently serving a 16-week jail sentence: six weeks for an activated suspended sentence and 10 weeks for possession of cannabis.

Judge Darlow commented "I agree completely with the Crown's stance."
