New Zealand: Mum jailed for taking drugs to inmate son

The Daily Post

Saturday 05 Nov 2011

A woman who smuggled cannabis into Tongariro Rangipo Prison for her son is now in jail herself.

Shona Lorraine Fernice Papanui, 52, shed hand, of Fielding, appeared in the Rotorua District Court yesterday for sentencing after pleading guilty to a charge of cannabis oil for supply. She was sentenced to eight months' jail.

Judge Chris McGuire said on October 31 last year Papanui went to visit her son in prison and was caught carrying drugs by a drug dog. She was carrying two packages internally, containing 20g of cannabis and three caps of cannabis oil. Papanui told police she had the drugs for her son who was was under pressure to get drugs.

Papanui's lawyer Katherine Ewen said her client had pleaded guilty at the earliest opportunity. Since the offending her mother-in-law, her partner's son and a grandchild had died and Papanui was now taking medication for significant depression. Papanui sobbed in the dock throughout the sentencing.

Mrs Ewen said her client was remorseful for what she had done and was at low risk of re-offending. She asked that Papanui be sentenced to home detention which she could serve at her sister's home in Feilding.

Rotorua Crown prosecutor Laura Owen said this was a case of prime deterrence as supplying drugs in prison made life difficult for prison staff and did not help with the rehabilitation of prisoners. The starting point would be 12 to 18 months' imprisonment.

Judge McGuire said it was frustrating to be sentencing a woman of Papanui's age for something so wrong. He said regrettably he was unable to avoid sending Papanui to jail.
