UK: Tenants who grew cannabis face eviction

Two Sheffield council tenants face losing their homes after they were caught growing cannabis by police.

Sheffield City Council has won possession orders on the tenants after they were found cultivating the illegal plant in their council homes.

Police found four large cannabis plants and 28 cannabis seedlings at Darryll Rigden's home in June this year.

He was convicted of the production of Class B drugs on 11th August 2011.

Sheffield City Council applied for a possession order and the case was heard before His Honour Judge Robinson in Mr Rigden’s absence.

The Judge decided that Mr Rigden had breached his tenancy and made an immediate possession order. He also awarded the Council its legal costs.

Tenant Mahmood Kadir was also caught growing cannabis by police in August 2011 when they found four mature and 12 smaller cannabis plants at his home.

Judge Robinson again made a possession order, which will remain suspended provided Mr Kadir does not carry out any further illegal activities at the property, or does anything which "causes a danger, a nuisance or annoyance".

The Council was also awarded its costs of £244.50.

Both cases were heard at Sheffield County Court on Monday 5th December.

Councillor Harry Harpham, Cabinet Member for Homes and Regeneration said: "We act swiftly and decisively when criminal activity is discovered in any of our properties.

"The ultimate price a tenant can pay for behaviour like this is eviction from their home, as Mr Rigden has found to his cost."

The two cases come after a series of eviction led by Sheffield City Council for related offences. In May, a man who had turned his home into a "cannabis factory" was jailed for nine months and evicted from his council property.

Last month, a tenant was also evicted after she had failed to vacate her home, in accordance to the court order made against her after cannabis was discovered in the property.
