Sam Mazibuko was arrested over the weekend at eNtokozweni bar after being found in possession of dagga weighing 0.05 grams.

He appeared before Lubombo Senior Magistrate Donald Mavuso and elected to conduct his own defence.

Coughing

Coughing as he stood inside the dock, Mazibuko pleaded guilty to the charge and said he used dagga to contain his asthmatic condition.

"I have been using this plant since I was 23 years, after I was diagnosed with asthma.

"Now I am 37 years old and the herb has been very helpful," said Mazibuko

He also showed the court some of his asthma medication to prove that he was indeed asthmatic.

Magistrate Mavuso demanded to see the tablets which were placed together with the dagga.

When the magistrate inspected the dagga, he saw five match boxes which were carrying dagga.

The magistrate asked the accused if he used match boxes to carry dagga.

"I do not buy your story that you are asthmatic. These match boxes show that you are selling the dagga; you are a dealer.

"You are poisoning others and then you come here to fool me," said the magistrate.

Mazibuko tried pleading with the magistrate to pass a lenient sentence, insisting that he was asthmatic.

The magistrate sentenced Mazibuko to 60 days of imprisonment with an option of E600 fine.
