UK: Wirral cannabis grower spared jail

Wirral Globe

Monday 12 Dec 2011

A Rock Ferry man who was caught growing cannabis plants for the second time has narrowly escaped going to jail.

David Thompson was told by Judge Gerald Clifton that the offence crossed the custody threshold - but because only a small amount of plants were involved he would suspend the sentence.

Paul Blasbery, prosecuting, told Liverpool Crown Court that police raided Thompson's flat in Old Chester Road, Rock Ferry on May 25.

They found five mature plants and ten young plants growing in artificial conditions. Analysis later showed the plants had a potential street value of up to £6,300.

Officers also found three bags of cannabis with a street value of £1,320, said Mr Blasbery.

29-year-old Thompson admitted growing the cannabis and said that he was a heavy user and it was for personal use.

He admitted cultivating cannabis and the court heard that he has a similar conviction in 2003.

Judge Clifton sentenced him to 51 weeks' imprisonment suspended for two years and placed him under supervision for two years with a 12-month drug rehabilitation requirement.

Gerald Pachter, defending, said, "He wants to clean his act up.

"He has a sufficiently high level of motivation to respond to a drug rehabilitation requirement."
