UK: Suspended term for man who grew £10k of cannabis

A BURTON man caught growing £10,000 of cannabis in his flat has narrowly escaped jail.

Stafford Crown Court Russell Fletcher, of Bramble Court, Stapenhill, was given an eight-month prison term, suspended for two years, after he admitted producing the Class B drug.

Stafford Crown Court heard police discovered a total of 58 plants in the 28- year-old's flat, which were being cultivated by a hydroponic system.

Robert Price, prosecuting, said the estimated yield from the plants would have been around 3.5 kilos, with an estimated street value of £10,000.

"This is a knife edge decision," Judge John Maxwell told him.

"There are many people who will think I am being too soft.

"I am sure you were expecting to go to prison — I hope you will respond positively."

The judge heard that when Fletcher was caught with the drugs in August last year, Suspended term for man who grew £10k of cannabis By David Cartwright at Stafford Crown Court he was still subject to a 12-month suspended sentence imposed for nondrug- related offences.

Fletcher initially maintained the drug would have been for his own personal use, but now admits that he would have sold some on a limited basis.

Steve Hennessy, defending, said Fletcher's prime motive was to provide himself with free cannabis.

However, when yields exceeded expectations, he would have made some financial gain.

"He turned to consuming cannabis in his own home as opposed to going out, getting drunk and getting himself into trouble," the defence solicitor said.

The court was told that as a result of the offence, Fletcher had lost his home, his job and contact with his young son.

He had since found another job and was taking steps to quit his cannabis habit.

As well as the suspended sentence Fletcher was given a two-month curfew and he was ordered to complete 250 hours of unpaid work, and pay £1,200 court costs.
