UK: Cannabis used to ease pain

Llanelli Star

Wednesday 04 Apr 2012

A PONTYATES man caught in possession of herbal cannabis by police used it to ease back and nerve pain from a traffic accident, a court has been told.

Karma Walsh, 38, of Heol Llanelli, pleaded guilty in front of Llanelli magistrates to possessing 0.30 grams of the drug.

The court heard how on Saturday, December 10 last year, PC Kylie Hopkins entered Walsh's home in relation to an inquiry over a missing person.

Prosecuting, Gerald Neave said: "The officer could immediately smell the drug and informed Walsh, who then admitted he had just smoked a joint. He gave her a small amount of leaf and said he was using it for his own personal use.

"She informed him she would be reporting the incident, recorded it in her notebook and then he signed it.

"There was no arrest and he was not taken to the police station."

Mitigating, Mike Reed said: "Because of a road traffic accident discs in his back and nerves give him a lot of pain.

"He is prescribed a morphine-based medication and uses cannabis to relieve the pain."

The court heard how Walsh had requested a THC inhaler from his doctors, which would allow the medical use of cannabis. Mr Reed added: "I am sure that many people if asked if people should be prescribed it for medical reasons that 99.9 per cent of people would say yes.

"My defendant was hobbling around when he came into court and if the doctor thinks he should have cannabis to ease the pain then that's what he should have."

Magistrates decided to give Walsh a conditional discharge for 12 months and ordered him to pay £45 court costs.

They also imposed an order for the forfeit and destruction of the herbal cannabis.
