UK: Judge reminds trio: Cannabis is illegal

A DISTRICT judge has reiterated that smoking cannabis is illegal.

District Judge Martin Steen told Leigh Hellier and brothers Benjamin and Bradley Smith, all of Torquay, that as far as the law was concerned it is illegal to be in possession or to smoke the class B drug.

The three men, aged 26, 25, and 33 respectively, appeared separately on un-related drugs charges.

But they were told that if they wanted to stay in Britain they should obey the laws of the land.

The judge said: "If you want to live in this country you have to obey the rules and you cannot smoke cannabis.

"If you want to indulge in this culture of smoking cannabis then go and live abroad. But if you prefer living here then you will stop."

He told Hellier in particular: "In this country cannabis remains illegal for now. They might change the law or they might not. You are welcome to campaign for a change in the law."

The court heard that Hellier, of Warberry Road West in Torquay, was in a black Mercedes with two other people when a police patrol car drove past.

Phil Sewell, prosecuting, said the police officers were alerted that something was untoward by the look from the car driver.

They followed the Mercedes from Ellacombe Church Road to Warberry Road West. Cannabis was found on Hellier. When police searched his house they found 340.34g of the drug in various containers throughout the house.

Hellier, who pleaded guilty to one count of possessing cannabis, said it was for his own use.

Alan Parsons, mitigating, said he had bulk bought 12 ounces of the drug to last him several weeks.

He said: "He has no previous convictions and no aggravating features. He bought cannabis in bulk for his own use."

The two Smiths brothers also pleaded guilty to unrelated yet similar charges for being in possession of 5.45g and 7.1g respectively at their home in Rowley Court, Torquay.

The three incidents happened in February this year.

The two brothers were fined £200, including £85 costs and £15 victim surcharge.

Hellier was fined £85 in costs and ordered to carry out 40 hours of unpaid work as part of a 12-month community order.
