Australia: Drug accused guilty over 133 cannabis plant 'experiment'

A PERTH businessman's bid to worm his way out of drug convictions has failed, after he was found guilty on all counts.

Thomas George Hartwig, 56, had argued 133 cannabis plants seized at his property were part of an experiment into vermiculture - the use of earthworms to improve farm soils.

The entrepreneur had more than $10 million in assets frozen after a July 17, 2011, raid on his east suburban Maddington business also netted 1.04kg of dried cannabis.

Hartwig had admitted growing and possessing the drugs, but argued he did not intend to sell or supply them.

A West Australian District Court jury took less than two hours to convict him late on Monday on one count of cultivation and one count of possession of a prohibited drug, both with intent to sell or supply.

Hartwig was remanded in custody to be sentenced on October 18.

During his week-long trial, the businessman had also testified he was conducting his own covert drug investigation after learning his wheelchair-bound son was a cannabis user.

Judge Allan Fenbury will now decide whether to declare Hartwig a drug trafficker.

Under WA law, convicted drug dealers can later be declared drug traffickers by the courts and have their assets forfeited to the state.

Hartwig's estimated $10 million to $11 million in assets included 10 properties, though nearly all were heavily mortgaged.
