MISSOULA - A medical marijuana lobbyist will not serve jail time for a federal conviction related to his business, Montana Cannabis.

Tom Daubert faced a 20-year prison sentence in U.S. District Court for charges related to a 2011 raid of the medical marijuana business, but instead will just serve five years probation.

During a federal court session in Missoula on Thursday, Daubert was sentenced to one count of conspiracy to maintain drug-involved premises. The 2011 raid was part of a large-scale crackdown on drug organizations in Montana, which were in violation of the federal Controlled Substances Act.

Daubert's story leading up to these charges is featured in the documentary "Code of the West," a film about the political debate surrounding medical marijuana in the state of Montana.

"I would encourage everyone, who paid for all this, to get involved in the movement to convince the federal government to adopt a more enlightened, cost-effective, humane policy on this issue," said Daubert.

Daubert was the head of an advocacy group that lobbied for medical marijuana in Montana. Since the 2011 raids, more than two dozen people have been indicted or sentenced on various charges. Montana Cannabis provided services for about 300 people in Missoula, Helena, Billings and Miles City.
