Borneo: Ex-postman acquitted of cannabis trafficking charge

KUCHING: A former postman walked out a free man after a Sessions Court judge here yesterday discharged and acquitted him of trafficking in cannabis, a dangerous drug.

Judge Amelati Parnell made the decision after finding that the prosecution had failed to establish a prima-facie case against the accused Abdul Malik Suaidi, 33.

Amelati decided after finding too many material contradictions and gap in the prosecution evidence; one being that the cannabis seized by the police raiding party was different in weight from that sent to the chemist.

Abdul Malik has been remanded in jail since the case was first mentioned in Court last year as the offence is non-bailable.

He appeared calm when the decision was delivered yesterday.

His family members who turned up in court were relieved to hear the decision.

He was allegedly trafficking in 75g of cannabis in a house at Taman Dahlia at Mile 5, Jalan Matang last year at about 2am on Aug 9.

Abdul Malik was tried under Section 6, punishable under Section 39A(2) of the Dangerous Drugs Act 1952 which carries a life imprisonment and not less than five years’ jail and a minimum of 10 lashes.

DPP Steven Beti appeared for the prosecution while counsels Roger Chin and Osman Ibrahim defended Abdul Malik.
