UK: Plymouth man who grew cannabis for pain relief is given curfew and ordered to pay court costs
Plymouth Herald Friday 03 May 2013 Nicholas Day, of Herbert Road, Stoke, appeared at Plymouth Magistrates' Court on Wednesday charged with producing the Class B drug. The court heard how the police executed a Misuse of Drugs Act warrant on Day's property on March 7 this year. Prosecutor Jenny Cater said that during their search they found four cannabis plants inside a specialist growing tent. Three of the plants were 13cm tall while one was 77cm tall. Officers also found drying leaves which weighed around 133.24g, with a street value of £377. The court heard how 239.36g of "skunk" cannabis, with a street value of £1,393, was also discovered. During interview the 44-year-old had explained to police he suffered severe back injuries which had left him permanently disabled. He had bought the equipment and set up the tent with reflective lining, along with lamps and fans, to grown the cannabis for his own use, he said. In mitigation, his defence solicitor said Day was offered an operation but was told there was a more than 50 percent chance it would lead to a deterioration of his injury and pain. Rather than take opiate-based pain relief and risk becoming addicted to such drugs he had chosen to self medicate to relieve the symptoms of pain, the court was told. Day told District Judge Ian Strongman he attended a college course one evening a week, and had erratic sleep patterns due to the pain. District Judge Strongman passed a community order, with a curfew between 4pm and 6am each day except the one day he attended college. He said Day would be fitted with an electronic tag for the next 12 weeks before ordering him to pay £85 court costs and £60 victim surcharge. Day, who relies on benefits, was ordered to pay via a £12 per fortnight collection order.
