US: Pot brownie charge dropped against Williamson County teen

Jacob Lavoro, 19, could have faced up to life in prison for making and selling 1.5 pounds of pot brownies in a Round Rock case that attracted national attention this summer.

But the first degree felony charge involving the brownies has been dropped. Lavoro still faces two charges, including a second degree felony charge for possession of THC and a state felony charge for possession of marijuana.

A grand jury indicted Lavoro on those two charges last week. Williamson County First District Attorney Mark Brunner said it was just more straightforward to charge Lavoro on the cases that did not involve the brownies.

Brunner said the brownies did contain THC — or hash oil, which is a resin made from marijuana — but the concentration of the drug had not been determined.

Under state law, the prosecution could have used the entire weight of the brownies — including the chocolate, the flour and the oil — in determining the severity of the drug charge against Lavoro.

Lavoro now could see a sentence ranging from probation to up to 20 years in jail. His next court hearing is Sept. 4.

“The family and I are very grateful that common sense has prevailed,” said Jack Holmes, a lawyer for Lavoro.
