US: Judge tosses out proposed guideline for 'Charlotte's Web' Kate Burgess My Fox Tuesday 25 Nov 2014 An epileptic for 35 years, Jennifer Reddan's seizures became uncontrollable, Until she started ordering hemp oil online. It provides a low dose of cannabidiol, or CBD, that she takes along with anticonvulsants prescribed by her doctor. It's expensive, and not regulated by the Food and Drug Administration, but she says it works. "The CBD usage has helped me so much," she said. "I'm doing so much better. I was falling off the bed there for quite some time, biting the side of my mouth, biting inside of my mouth, hurting myself." Reddan is among thousands disappointed to learn that an administrative judge in Tallahassee has tossed out the Florida Department of Health's proposed guidelines for "Charlotte's Web," a strain of medical marijuana processed into a marijuana extract that is high in CBD, but low on tetrahydrocannabinol, or THC. The judge rejected the guidelines after finding issues with 13 proposals, most notably, the lottery system proposed for potential growers. Florida Medical Cannabis Association challenged the guidelines. "We believe that the lottery rewarded the luckiest, not the best. You're talking about medicine [for] mostly sick children," said Louis Rotundo, a lobbyist for the association. "We didn't think that was responsible, to just award a license, just because they were lucky enough to get their name drawn." An advocate for the use of low THC cannabis, Rotundo said health officials misinterpreted the law. The judge agreed, ordering the DOH to come up with new guidelines for how to implement the program, meaning the January 1 start date, outlined in Florida Senate Bill 1030, may get pushed back.
