US: Colorado declares tainted marijuana a public threat

Colorado is cracking down on tainted pot.

Gov. John Hickenlooper recently ordered state agencies to destroy all cannabis plants and products containing unapproved pesticides, the Denver Post reports.

Effective immediately, agencies must screen marijuana crops and products for a number of pesticides not approved by state regulations.

“When a pesticide is applied to a crop in a manner that is inconsistent with the pesticide’s label, and the crop is contaminated by that pesticide, it constitutes a threat to the public safety,” the order says.

The actions come after a year of pesticide problems within the state’s legalized cannabis industry, which came to the forefront last month in a class action lawsuit against marijuana producer LivWell for using a dangerous pesticide that produces hydrogen cyanide gas when high temperatures such as a lighter flame are applied. Denver city officials placed a hold on over 60,000 plants to screen for pesticides, but were released back to LivWell after passing residue tests.

Hickenlooper’s order leaves no room for trace amounts, however, as agencies can use all investigative and enforcement authority to deal with tainted pot, “including, but not limited to, placing contaminated marijuana on administrative hold and destroying contaminated marijuana pursuant to existing law.”

Colorado will pave the way for pesticide regulation in other legal states like Oregon, which will begin screening dispensaries for 60 different types of common pesticides in 2016.
