Israel: Minister Erdan announces decriminalization policy for cannabis use

Policy includes fines instead of criminal penalties for non-multiple repeat offenders.

Public Security Minister Gilad Erdan held a press conference on Thursday to announce his new plan – 'Shifting to decriminalization with responsibility.' Erdan introduced his 'four felonies plan' that would make decriminalization over cannabis use harder, but added that it should first get the cabinets' stamp of approval, which might take over three months. Erdan also stressed that the plan only applies to the users of up to fifteen grams of cannabis.

According to the new policy, in cases of a first felony of cannabis use, a fine will be given with no criminal record. In the second case, a double fine would be given with no criminal record. The third felony could be closed only with a special settlement, "according to a law passed a few years ago, which has started to be implemented in recent months," Erdan explained. "This law holds that if there is consent by the person, he goes on a track in which the police have more options to close the case and delete the criminal record quicker." In the case of a fourth felony, the criminalization process starts according to the police recommendation.

When it comes to youth using cannabis the process is different. After the first felony the minor will be directed to special treatment. The second felony will be closed with a special settlement and in the third the criminalization process will start.

"We want to educate our youth that using drugs is damaging," Erdan said. "On the other hand, the police do not have the right tools to deal with the damages of using drugs. For example, to police do not know how to address people who drive under the influence of drugs. This is why we must have a wide and conclusive policy change."

"I have always taken this topic seriously and I would not make irresponsible decisions about it, without understanding the policy's consequences," he added. "The legitimacy of using drugs has only grown bigger," he said.
