Scotland: No jail for cannabis grower nabbed with £15k stash who said it was for sick mum

Hamilton Advertiser

Tuesday 10 Mar 2020

A Hamilton cannabis grower avoided prison this week after claiming he cultivated the drug for his sick mum.

Twenty five plants worth up to £15,000 were seized when police raided the property in Brankholm Brae.

Mark Barclay, 38, admitted producing cannabis at his home in March 2018.

Neil Thomson, prosecuting, told Hamilton Sheriff Court officers arrived at the house armed with a search warrant.

He said: “Once inside they were aware of a pungent smell of cannabis.

“The cultivation was found in the loftspace. The plants were described as being at the mid to late stage of growth.

“Police experts estimate the value at between £200 and £600 per plant, meaning in total they were potentially worth up to £15,000.”

Barclay’s solicitor, Jackson Bateman, pointed out that no sophisticated growing equipment was found.

This suggested he was not involved in commercial supply of the drug.

Bateman said: “It was very much a traditional cultivation.

“It was not mass production of cannabis – it was confined to the loftspace.

“The cannabis was for his mother who has various health conditions and suffers significant pain.”

Mr Bateman pointed out the offence was committed almost two years ago and Barclay, who has no previous convictions, has been in no trouble since.

After studying a criminal justice social work report, Sheriff Thomas Millar ordered Barclay to do 200 hours of unpaid community work within 12 months.
