The Democrat-controlled General Assembly of the Commonwealth of Virginia voted on Friday, February 5 to legalize the consumption of cannabis for adult use. After the House of Delegates and Senate conference regarding the differences in their proposed bills, the final version will be sent to Governor Ralph Northam (D). The program is expected to start as early as the summer of this year with sales beginning in 2024. We anticipate the program will be overseen by a newly created regulatory entity. The proposed bills legalize possession of up to one ounce of marijuana for those 21 and older. The Senate’s version allows for localities to opt out of allowing retail stores in its jurisdiction. The revenues derived from the program will fund pre-K and public health programs as well as addiction treatment programs. A fund will also be created to remedy the effects of the cannabis’ historic criminalization.
