Germany: Bavaria to ban cannabis smoking at Oktoberfest despite federal legalisation

Bavaria’s government aims to curb public cannabis consumption despite the federal government’s recent legalisation law, citing concerns about health protection, especially for children and young people. Clemens Baumgärtner, head of Oktoberfest, highlighted the festival’s family-friendly atmosphere and expressed opposition to allowing cannabis consumption, stating, “A family festival like the Oktoberfest and cannabis consumption don’t go together.” Bavarian Premier Markus Söder echoed these sentiments, stressing the importance of protecting children and young people by limiting cannabis consumption in public spaces. Bavarian Health Minister Judith Gerlach highlighted health protection as a primary motivation behind the proposed ban. Germany’s new law, which came into effect on April 1, allows adults over 18 to possess up to 25 grams of dried cannabis and grow up to three marijuana plants at home for personal use. However, the substance remains prohibited for minors, and consumption is restricted within 100 meters of schools, kindergartens, and playgrounds. The legislation also includes provisions for the establishment of clubs where individuals can purchase cannabis, with this aspect of the law set to take effect in July.
