UK: Jersey Overhaul of cannabis laws to be debated after the election

Proposals to overhaul the island’s cannabis laws will be brought back “later this year”, the Health Minister has said, after he cancelled next month’s debate.

States Members had been due to debate widespread changes, the most far-reaching of which could have seen the government cultivate, regulate and sell cannabis to registered islanders as part of a trial.

However, Health Minister Tom Binet informed Members that he has withdrawn his proposition and it now will not be progressed before this summer’s general election.

Deputy Binet told Express he was confident that the matter would return to the political agenda following the election, regardless of who is Health Minister after the new government is formed in June.

“The decision of the Assembly [in 2024] will remain on the books,” he said.

Feedback following the publication of the proposition just before Christmas had prompted the decision to withdraw it, he added.

“There was concern about some of the wording and we didn’t want to proceed with something when it wasn’t quite right,” he said. “There’s a hell of a lot [of other business] to be covered over the next two months, so I think it’s the right option to bring this back later in the year.”

Alongside the proposed sales trial, two other less-radical reforms were proposed. The first option would have seen cannabis remain illegal, but prosecution cease for people found in possession of, or cultivating, small amounts deemed to be for personal use, with indicative thresholds set in guidance.

The second option would have made possession or cultivation below a specific legal limit – such as up to 15 grams or two mature plants – no longer a criminal offence, provided the cannabis is for personal use and not supplied to others.

The proposition had been brought in response to a 2024 States decision, when Members backed a call from Deputy Tom Coles for the government to bring forward fresh legislation around cannabis regulation by November 2025.

In the email to States Members, the Health Minister said: “Since lodging P.116/2025, we have received a number of feedback and comments.

“From these it has become clear that further refinement of the three options is needed, as well as time for scrutiny and consideration of the wider impacts of these changes.

“Having discussed this with Deputy Coles earlier this afternoon [Friday] we believe the best course of action is to withdraw [the proposition] at this time and relodge [it] post-election.”

He added that delaying the debate until after the election would “better allow the Assembly to do justice to these significant and complex proposals”.
