UK: Drug accused to use human rights defence

A former charity director is using the new Human Rights Act to defend
himself against a possession of cannabis charge.

Jerry Ham faces a jury at Southwark Crown Court after being arrested with
1.8 grams of the drug in London last year.

His lawyers will argue that his arrest was a breach of Article 8 of the
Human Rights Act.

That part of the Act enshrines the right to respect for private and family
life.

Civil rights organisation Liberty is backing 33-year-old Ham, from east
London, who founded the homelessness charity Groundswell.

The case is made more poignant by the fact that police in parts of
neighbouring Lambeth have stopped arresting people for possession of cannabis.

Instead they dealing with the crime by confiscation and a formal warning.

Leslie Iverson, visiting professor of pharmacology at Oxford University,
who is also a specialist adviser to the House of Lords science and
technology committee, will give evidence as an expert witness for Mr Ham.
