UK: Husband who grew drug is spared jail

A MAN who grew cannabis in his garage to help ease the pain of his
arthritic wife was allowed to walk free from a court yesterday. But Malcolm
Jennison, 52, was told by the judge that if he continued to break the law
he would be sent to prison.

Jennison gave up his career as a nurse 10 years ago to care for his wife,
Sandra, 42, who suffers from rheumatoid arthritis and severe spondylosis.
He crushed the dried leaves of his crop to make cannabis cakes and tea,
Shaun Dodds, prosecuting, told Teesside Crown Court.

Two years ago Jennison was cautioned by police in identical circumstances.
When police went to the couple's home in Seaton Carew, Teesside, last
December they found eight cannabis plants growing in the garage.

Robert Galley, defending, said the cannabis cakes and tea were so
successful that sometimes Mrs Jennison had been able to abandon her wheelchair.

Mr Gallery said: "Her prescribed painkillers sometimes had unpleasant
side-effects. This was a mercy mission for pain relief.

"He told me that he did not realise the potential for the matter being
taken so seriously. He accepts it was not a wise thing to do."

Judge Tony Briggs told Jennison: "I am satisified that your reasons were
genuine. This does not mean that this is legal. You have had one warning
and this is the second time.

"If you do this again a court will have no alternative but to lock you up.
Last warning."

Jennison was given a two-year conditional discharge after pleading guilty
to cultivating cannabis.
