Malaysia: Fisherman sentenced to death for drug trafficking

KOTA BHARU Aug 9 - A fisherman was sentenced to death by the High Court
here Saturday for trafficking in 527.5 gm of cannabis about two years ago.

Mijan Mohamed Deros, 57, of Sri Tanjong in Panchor, Muar, was found guilty
of committing the offence at an illegal jetty in Rantau Panjang at 5.10 pm
on Oct 18 2001.

In his judgment, Justice Datuk Sulaiman Daud said that the defence failed
to raise a reasonable doubt on the prosecution's case.

"Mijan's evidence left many questions unanswered and he lacked
credibility," he said.

Justice Sulaiman said that the defence tried to create the impression that
Mijan was a drug addict and that his family members knew of his addiction
and that the cannabis was for his own use.

However, he said, the defence did not call any members of his family to
testify on his behalf.

He said that the prosecution on the other hand had proven that the cannabis
was in his custody and to be trafficked.

"If it (cannabis) is for his own use, it would have been easier for him to
have it in bulk instead of in small packets," he said.

Mijan was arrested by the police who found 84 packets of cannabis on him at
the illegal jetty after crossing the Sungai Golok at the Malaysian-Thai
border.

In mitigation, defence counsel Latifah Ariffin said that Mijan was a first
offender and had now realised his mistake.

She said that Mijan was now a lonely man as he had been divorced by his
wife and his children had neglected him.

Justice Sulaiman allowed his application to be sent to the Johor Bahru
prison pending his appeal against conviction and sentence.
