Note: Our newshawk writes: Breaking News: Jurors told a substitute judge
today that they are deadlocked 11-1, but judge refuses to say which way. A
verdict of 12-0 was reached regarding the peyote for both Steve and
Michele. A verdict of 12-0 was reached for Michele with regards to the
mushroom stem; 11-1 for Steve. We believe the number show an acquittal for
the peyote and for Michele on the mushroom stem. By that logic, the 11-1
vote is in our favor and that was certainly our impression in looking at
the jury today. The substitute judge instructed the jury to return to its
deliberations and report back to Jucge Cosgrove at 8:30 a.m. [Thursday]

JURY CONTINUES TO DELIBERATE IN KUBBY MARIJUANA TRIAL

Jurors in the marijuana-possession-for-sale trial of Steve and Michele
Kubby deliberated Monday for a second day without a verdict.

The Kubbys are being tried in Placer County Superior Court on several
charges stemming from a Jan. 19, 1999, raid on their Olympic Valley
home. A total of 265 marijuana plants were confiscated from their
indoor garden.

The jury is to return today for an open-court session to have
testimony from the trial read back.

The eight-woman, four-man jury began deliberations Friday after
hearing testimony over four months. Steve Kubby was Libertarian Party
gubernatorial candidate in 1998 and a key advocate two years earlier
for Prop. 215 -- a voter approved initiative that allowed medicinal
use of marijuana.

Both Kubbys had doctors' recommendations to smoke and grow pot for
their own use under Prop. 215. Prosecutors contended that the amount
of the crop would be too large for the couple's personal needs and
that the cannabis was being sold to Oakland and San Francisco buyers
clubs.
