POT ACTIVIST TO GET HIS DRUGS BACK

SECHELT, B.C. -- Steve Kubby is hoping his days in Sechelt provincial
court are finally over.

Kubby learned this week that an order has been issued asking the
Sunshine Coast RCMP to return his marijuana and property that was
taken in a police raid last April.

"We did have the law on our side and we were prepared to go to the
Supreme Court, but it's nicer to do it in a friendly way," Kubby said.
"I think Sechelt can set an example for cases around the world. I
can't say enough about the judge and everyone involved. They have all
been so helpful. We're here in Canada because the Charter of Rights is
respected and upheld."

Cpl. Mike Frizzell said the Department of Justice issued instructions
to the Federal Crown agent to consent to the release of the grow
equipment and the drugs.

"The judge didn't have to make a ruling, as Crown consented to the
release of the items," Frizzell said. "I'm planning on talking with
Mr Kubby soon and I hope he understands our position is simply to
abide by the law. Once we get all the proper documentation from the
courts we will proceed from there."

Kubby and his wife, Michele moved to Sechelt last year with their
children aged six and two.

Kubby was arrested on an immigration warrant in April after coming to
the attention of the police in media reports about medicinal
marijuana. Since then, he has applied for political refugee status -
a move similar to fellow US 'pot refugee' Renee Boje, who is still
wanted in America on marijuana charges.

Kubby's immigration hearing is scheduled for eight days in early
March.
