UK: Pubs told to stand firm on cannabis

Thursday 29 Jan 2004 Pubs need to take a firm line on customers smoking cannabis despite widespread public confusion, says The Publican's legal team. With the drug now downgraded to a Class C classification and police forces turning a blind eye to cannabis use in private, there are fears that pubs could face problems enforcing bans. The Association of Chief Police Officers (ACPO) has admitted that it has issued no guidance to forces specifically on dealing with pubs. Police chiefs have also warned that many members of the public now mistakenly believe lighting up a joint is legal. Suzanne Davies, of licensed trade solicitors Joelson Wilson, said that licensees need to be clear on the law - cannabis use in public is still a crime. 'There shouldn't be any uncertainty about having a clear 'no drugs' policy and requiring customers to abide by it,' she said. Ms Davies also warned that pubs with children's certificates would need to be particularly vigilant in enforcing the ban even if society generally becomes more relaxed about cannabis. The ACPO guidelines make it clear that police will be expected to act quickly to deal with cannabis use if children are nearby.
