UK: Cannabis appeal on health grounds

BBC Online

Monday 11 Oct 2004

---

Three men are appealing against convictions for growing and possessing
cannabis because they were using the drug medicinally.

One of the men will try to persuade the judges in the Appeal Court on
Monday he was in so much pain a defence of being under duress should have
been allowed.

All the appellants believe this could have resulted in a different verdict.

BBC Crime Correspondent Neil Bennett says the case will be an important
test of whether the legal position on cannabis is shifting.

The Home Secretary David Blunkett has reclassified cannabis as a less
serious drug but it is still a criminal offence to possess or supply it.

Cannabis has been found to relieve the symptoms of multiple sclerosis and
trials are underway to test its effectiveness and safety for other
purposes, as part of cancer treatment for example.

But the medical argument has not been accepted by the courts
